On February 16, 2024, Steven Guilbeault, Canada’s Minister of Environment and Climate Change, released a discussion paper on the Clean Electricity Regulation (CER). The update paper, issued by Environment and Climate Change Canada (ECCC), outlines proposed changes aimed at enhancing regulatory flexibility.
Key considerations for stakeholders include transitioning from the Emissions Performance Standard to an Emissions Limit Approach, extending the End of Prescribed Life (EoPL) for certain units, and revising treatment for cogeneration units. Additionally, the paper suggests removing provisions related to peaker plants and introducing changes to emergency circumstances rules.
There is contemplation regarding extending of the CER to all new units within a facility collectively amounting to 25MW or more. This proposal aims to address unintended problems and ensure regulatory consistency, while also considering exemptions for remote communities. Overall, these proposed changes highlight the importance of closely monitoring regulatory developments.
